Here is his reply:

Dear Tracy:

Thank you for your concern regarding the Ebay policy. However this transaction doesn't violate ebay policy i.e. circumvention of fees. The ebay policy prohibit the following

Unreasonable shipping or handling costs - Listings with low prices but unreasonably high shipping or handling costs.

Here we don't have a low price with an unreasonable high shipping or handling cost as the item is priced at $110 (small to some but not most) and the shipping & HANDLING charge is only $50 no t even half. In addition, I find that most sellers in every business fail to charge sufficient amounts to cover shipping and handling as they forget that there is a handling cost which includes, time value of money, vehicles, wear and tear, vehicle insurance, time and gasoline which on an SUV aint cheap. Not to mention lines and supplies. Not only is the aforementioned a cost for travel to a shipping center but also to procurement centers for supplies. In addition, we have to consider that in a week a seller may not sell more than one item thus this cost must be born by one item. This means that the seller has to charge shipping to cover those cost if he or she sells one low cost item and has to ship it.

I wish each buyer was right next door so I could hand them the item for $110 + $2 walking fee..but they aren't. Unfortunately they are everywhere so I have to use intemediaries which impose a substantial transaction cost..including discussion of shipping and handling fees. LOL.

I insure all of my items personally i.e. I am prepared to pay out of my pocket the amount due the buyer if the package does not arrive. This is not cheap. However, if these costs are not captured then I would not be able to sell the items and the customers would suffer.

I do understand how sometimes we can see something and want it on impulse before we have the chance to evaluate the entire offer. Trust me I laughed when I read you initial email because I have done the samething. So, if you don't want the item let me know so it can be relisted and I would ask that you forward the relisting fee of $2.80 to my paypal account. Thanks again Tracy and I look forward to your reply.

Which his whole argument is total moote (sp?) regarding 'handling' because he isn't consistent in his auctions with shipping/handling!! Next step??

Well I personally dont think Ebay will do anything so if you really dont want it(even though its still a great price) just do a mutual agreement and be done w/ it. Then you could still leave him the appropriate feedback

i think you should ask why shipping on his other pair was only 12.

Completely agree! Inequitable shipping fees!!
Just watch that he uses a paypal shipping invoice, hence there is NO WEAR & TEAR on his vehicle to ship the item!! Post office just picks it up at his door!!

I agree that the shipping is laughable and a complete rip off, and for that I reported several listings of his.

However... you should have looked at the shipping costs beforehand. It's not like there was no shipping listed and a $50 charge was tacked on with the invoice, there was prior warning. I personally think you should pay for it, not because it's "right" for you to do so, but in order to save yourself negative feedback. It's still a good deal, why not take it?

I'm pretty much resolved to buy it. I agree that I should have looked at the shipping cost. . .I got that lecture in my own head seconds after doing it. . I was just hoping that maybe we could withdrawl the auction and do it again (me paying) him assuming responsibility for having an outrageous shipping fee and paying ebay dues on what he is selling. . .ALL of them!! Oh well. . .live and learn. . thanks everyone for your support. . and constructive comments

He won't ship it any other method than Express Mail? Yikes.

Lets add in all costs of selling on ebay into the handling fees. Well I need a computer and internet so part of that cost is associated into handling. Oh wait, I also need electricity to power the computer and a living space to keep it in. Lets add that in. I can't go to the post office NAKED so my clothes is part of the handling fee also.

What a douchebag making these shitty excuses for the shipping costs. He was probably waiting for someone like you to get excited about the low, yet not incredibly low price and just go for it.

Tracy - I WOULD NOT PAY!!

if you do pay and he sends the item and it gets lost in the mail, they post office will only reimburse you for the cost of the item, not the cost of the item plus shipping and insurance. Therefore you will be out the $50 shipping fee and the $19 insurance fee. I don't know about you but $70 to be stiffed out of it alot of money to me!!!
He's willing to let you out of it, get out!!

Tracy if you do pay... tell the bastard to overnight the freakin jeans..... the $50 will more than cover the cost of that and tell him that insurance cost like $2. You are not an idot.... tell him you sell stuff on ebay and you know how much insurance cost. This is a pair of jeans not LIFE insurance! I truly hate this guy. All he does is contradict himself. I'm reporting him again.!
