The gift option on Paypal -- secure?

So I've talked with a merchant a couple days now about some jeans. He's asking that I send them via "gift" instead of merchandise, so he can avoid fees.


I know you cannot dispute Paypal gift transactions, but if the merchant decides not to ship the item, will I still be able to file a chargeback with my credit card company if that's what Paypal withdrew from?

 

I don't mind paying as a gift to get rid of fees, but if it also gets rid of all the security I have to make sure I get my item.. then I dunno :x

I've never had a problem with an international transaction where I had to return the item or never received it, but if you falsify the information on those documents, the feds could technically go after you for that (this applies towards the practice of devaluing items on customs forms, as well). I used to mark things as gifts, but after one of my buyers got dinged on fees anyway--she pointed out that the "Boutique" in my store name probably gave things away--I stopped doing even that.
