CC chargeback needs 30 days for the seller to respond. They gave me a temporary credit back already. But I told him I won't wait until the result to report him.

He's still playing games now. He said he needs us to send him emails because he cannot see the pms. And he needs to see the pictures and evidence of being fake. All these are done by his sister, but he'll take care of it asap.

I'll send him a screen copy of what I posted, and see what he'll say.

Ling, I've been talking to Yen over email and I gave her lots of information about contacting the police. I'm also a member in another forum and those ladies would be more than willing to help you report him to the police and proceed to small claims court.

Also because of the large amount, he can be prosecuted with theft if you two decide to take the case up with the police. And since the items he sold are FAKE which is ILLEGAL, that's another charge that can be added onto theft. I'm not too sure about Texas state laws but in CA, theft and trafficking of illegal goods (evident by the fact that more than one person received fake stuff and I know he's also attempting to sell another fake damier speedy on another forum) can result in prison time.

In Texas, anything over $1000 is a felony. I hope you guys get your money back, because that is truly trifling.

FINALLY, HE ASKED ME TO SHIP THE BAG FIRST, GAVE ME AN ADDRESS IN HOUSTON. That's after I told him that we'll report him with all his info., and the consequences can be really bad.

BUT I ASKED FOR THE REFUND FIRST. I said "payment always comes first for internet purchase. If you don't receive the bag, you can always claim from paypal to get your money back."

I sent him the invoice. What do you ppl think? I worry he'll bargain if I send the bag first....

Well.... usually a person will not refund you without having the merchandise in hand b/c you could just not send the bag. Unless you're treating like you're selling it to him. But then he can say you sold him a fake and get his money back. This could be totally dramatic. But I'm like you I'd be scared to just put in the mail and hope he does the right thing. Good luck.

No, in THIS case, he needs to refund YOU first. YOU have already proved that you are a good seller/ buyer, now he needs to do the same.

After the negotiation, he agrees to issue refund first at SUNDAY NIGHT. I hope he can keep his words. Let's wait and see...

i am just scared that he will do a charge back on you when you do paypal....

Let him use the refund link! Dont send the invoice! You will lose money in fees.

Cannot use refund link because it's over 4 months already. But I asked for extra fees from him. What if he really asks for chargeback later?

Too bad you couldn't get a bank transfer or money order refund. There is no way the seller can do a chargeback or claim, but you may get a fake mo or may not get the refund at all

i would say in this case a MO or even western union transfer is better. b/c there's no way he can get the money back
