Am I being unreasonable??? - eBay question

So I purchased a pair of foam crowns about a week ago for $160 + $10 shipped. Here is a link to the auction:

When I received the jeans yesterday I was so excited, but my heart sank when I opened the package and the "foam" crowns were a much lighter shade of teal than I had expected. I had a pair of first quality foam crowns on hand that I had purchased to resell (not my size), and when I compared them, these were much lighter.

And when I looked closer, I realized the crystals were a different color than the ones on the foams I owned (the ones on the pair I owned had a pinkish hue to them, and the ones on the pair I had just received had more of a clear sparkle to them). Additionally, the crystals were much more sloppily placed on the new jeans, AND the new jeans were not originally intended to be crystals. They were placed on top of embroidery instead of on empty space like normal crystal crowns are. These are floor samples, and I was aware of this when I purchased the jeans, but that doesn't mean I should be getting something other than what I paid for.

I have emailed the seller to request a refund and he is not budging, saying that the pictures were clear and posted in the auction and that "each item to show its true color and that we are not responsible for color differences due to flash and lighting as sometimes may occur or any detailing that might appear more or less defined when photographed. By you not being able to tell the color of the crown and color of the crystals does not mean that I misdiscribed the item."

Here are pics of the new jeans compared to the pair I already own. The color difference is much more vivid in real life.







Additionally, there is a lot more distressing on the pair I purchased than on the pair that I own (the new pair is amost completely threadbare on one of the pockets), and I feel they would probably fall apart after one wash or wear, although I did not mention this in my correspondence with the seller.

I know he is a member here and I don't want to start a ton of drama, but I would like to know if I am being unreasonable or if I really have some recourse for this issue. Did the auction accurately describe the jeans, and should I just give up on my dissatisfaction? It is unfortunate because I was SO excited about receiving a pair of foam crowns. Additionally, if there is recourse for this, how should I proceed?

ummm... I'm really not sure. I see the difference in distressing, but from the pics I can't tell the color difference that much. The thing that WOULD really bother me is that the crystals are placed on top of stitching, and that the jeans were not originally intended to be crystallized, w/ the outline stitching and spaces for crystals. Did the auction listing mention that?

The color difference is HUGE. That's the biggest deal to me. We're talking pale aqua vs. vivid teal.

The crystals being placed on top of the stitching was not mentioned in the auction, although the seller maintains that I should have seen this in the pictures.

Yeah, the crystals on the stitching don't look too good. I would ask to return them.

The crystals being on top would bug me too....what does the inside tag say???? Does it say "F" for foam?? Maybe they aren't really foams, but the crowns that are close in color then he/she put crystals on top to make them look like real foams??? I recently bought some jeans from a HF member and she thought they were foams because the color was the same, but they didn't have crystals...we worked it out, but I wonder if these are similiar jeans then someone put the crystals on top to sell them as foams? Not saying that HFer who sold them to you wanted to scam you or anything, but its possible.....

I think that the crystals being placed on top should have been mentioned in the description, I think any flaw or change should be mentioned THEN pictured....

The tags are missing on the inside of the jeans because these are "department store samples." There is a handwritten tag on the inside reading "Jagger Garbi 27 Dk Vapor #00"

The seller claims he did not add the crystals himself but purchased them like that.

I have already asked to return the jeans and the seller has refused. I can copy and paste the series of emails on here, but I'm not sure that would be wise. I am unsure of where to go from here.

They used to sell all jeans with missing crystals. Do search for ebay name there was alot of drama with crowns they have sold

if you're going to be petty, you should spell sweetie and hating right.

as for the important issue-- i agree! i would be pissed if i got crystal crowns that were customized, when they were advertised as being the real thing. can you go through paypal?

these aren't top notch jeans. they're irregular.

the jeans are regular crown jeans and the irregularity is that these were never meant to be crystallized but for whatever reason, crystals were placed on top of the stitching. The crystal placement is very sloppy.

i agree - this would bother me and the seller should refund or offer a replacement.

the jeans aren't top notch. they're not even sample jeans. those are regular crowns that were never meant to be crystallized. they're irregular.

and, yep, i remember all that drama, especially the bit where the seller kept ending all the auctions simply because the bids weren't high enough. whatever.

If I were to take a guess at them. I would say they are a same was kinda looks like garbi. I think "someone" put crystals on them thinking they were supposed to have them but judging by them they arent supposed to

Yeah, I don't even think these are foams. Foams are always supposed to have crystals, and if they didn't have crystals, they would have blank spaces where the crystals should have been.

I concur...this amounts to false advertising if the jeans were self-crystallized and advertised as factory crystallized.

I'd be very upset if I bought something that was sold as something more expensive...seems like someone intentionally altered them to pass them off as the more expensive pair (and I'm not accusing anyone here, it could have been before he/she bought them that they were altered). BUT, I would expect, if the seller was selling jeans for a living, that he or she be informed enough about his or her product to be able to tell the difference between an altered and unaltered pair with regards to all aspects incl. crystals. Also, good customer service never hurts anyone, but bad customer service will scare your potential future customers away.

I am also a powerseller and live in the NYC area and I know where the the sellers jeans are coming from. The Foam Crystal Crown jeans that you purchased with the tags cut off are IRREGULAR Jeans. I do a lot of shopping in the NYC area and I have seen jeans with the cut off tags with the inner hand writing i.e. "Jagger Garbi 27 Dk Vapor #00". The FIRST QUALITY jeans do not have this.

Tiff: Yes, crystals are attached over embroidery. Look at the close up pictures at the top of the page. The crystals on the Foams I owned are neatley and tightly placed. The ones on these are sloppy and not tight and neat like real Foams (it is particularly noticeable on the cross at the top of the crown).

From the post above ^^ , Obviously this seller is not concerned with customer service for buyers who spend a LOT of money. That is unfortunate.

The jeans are authentic, it looks like R&R goofed on this pair and it got scraped and ended up in the discount dept. store.
